SCOTUS Allows Federal Border Agents to Remove Texas Razor Wire Barrier

The divided decision lifts the injunction placed by the Fifth Circuit Court of Appeals.

The U.S. Supreme Court has lifted an injunction placed by the Fifth Circuit U.S. Court of Appeals that prohibited border agents from removing razor wire installed by the state of Texas along the U.S.-Mexico border. Texas had filed suit against the Department of Homeland Security and the appellate court had placed the injunction to stop the removal of the barrier.

The high court ruling means that President Biden’s administration may continue to remove the concertina wire while the lawsuit proceeds. The president’s administration claimed that the wire harms migrants and stops agents from reaching them as they cross the Rio Grande.

The Fifth Circuit Court of Appeals has scheduled oral arguments on the case for February 7.
